Premarital (prenup) Agreements
Premarital agreements (or prenups) are not only for the wealthy. Couples who are contemplating marriage are more frequently choosing to enter into premarital agreements for many different reasons. Although asset protection is a primary reason to consider having a premarital agreement, a well-crafted, comprehensive premarital agreement is a good way to avoid conflict and expensive litigation that sometimes arises in divorce.
A premarital agreement is a contract entered into and signed before marriage. A premarital agreement can establish rights and obligations with respect to the ownership and use of property, the acquisition of property during marriage, spousal support, debt payment, and inheritance rights. Before entering into a premarital agreement, both parties should disclose the nature and extent of their assets, debts and income to each other or waive their right to have such disclosure prior to signing their agreement.
Our firm has experience in drafting the agreements, representing clients during negotiations, explaining and educating clients about the legal significance of the agreements and the ramifications of either having or not having an agreement. We also evaluate existing premarital agreements for our clients.
